DSA Notice & Action Procedure | Italia Quality Legal Center

Italia Quality provides a content-notice procedure designed, where applicable, around Article 16 of the Digital Services Act and Italian review law.

1. Who may notify

Any person or entity may notify content they consider illegal. For reviews subject to Law No. 34/2026, a reviewed establishment’s legal representative or delegate may notify failure to meet lawfulness requirements.

2. Notice contents

A sufficiently substantiated explanation of why the content is allegedly illegal or non-compliant.
The exact URL or precise content identifier.
Name and email address of the notifier, except where law provides an exception.
A good-faith statement and, where relevant, documents proving authority or representation.

3. Channel

Notices may be submitted through electronic tools provided by the platform or, where unavailable, to UESE’s general contact info@uese.it with subject “Italia Quality – Notice & Action”. Privacy-only matters should use privacy@uese.eu or dpo@uese.it.

4. Intake

The platform may acknowledge receipt, assign a case identifier and request additional information where the notice is insufficient to identify or assess the content.

5. Decision

Notices are assessed in a timely and non-arbitrary manner, considering law, policy, content, context and evidence. A notice does not automatically cause removal.

6. Reviews and Law No. 34/2026

For covered sectors, checks may include visit date, personal experience, relevance, incentives, authenticity of any “verified” label and the two-year period.

7. Outcome

Where applicable, notifier and affected user receive essential outcome information, subject to privacy, confidentiality, security and legal duties.

8. Abusive notices

Manifestly unfounded or serially abusive notices may be addressed proportionately without impairing the right to submit legitimate notices.

9. Authority orders

Communications from competent authorities follow a dedicated verification, retention and compliance process under applicable law.
